These Terms & Conditions (“Terms”) govern your access to and use of CollegePlanner360, including the website at collegeplanner360.com and any related applications and services (collectively, the “Service”). The Service is owned and operated by Mathurs LLC (“Mathurs,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. The Service is not directed to, and may not be used by, children under 13, and we do not knowingly collect their information. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. You are responsible for keeping your account credentials secure and for all activity under your account.
CollegePlanner360 provides decision-support tools and educational information: planning frameworks, recommendations, opportunity and college discovery, application and essay organization, and optional human counseling services. The Service is not a guarantee of admission, scholarship, financial aid, placement, or any particular outcome, and does not constitute legal, financial, medical, or other professional advice. Rankings, recommendations, timelines, and “fit” indicators are editorial and informational, may contain errors or omissions, and should be independently verified. You are solely responsible for the decisions you make. Application dates, deadlines, and requirements shown in the Service are provided for convenience only and may be incomplete, outdated, or incorrect. CollegePlanner360 is a tool to help you organize and manage your application process — it is not the official system of record. You must independently verify all dates and requirements with the Common Application and each institution’s official website, and we are not liable for any missed deadline, error, or mismatch.
You retain ownership of the content you create on the Service (such as essays, notes, and lists). You grant Mathurs a limited, non-exclusive license to store, process, and display that content solely to operate and improve the Service for you. The Service does not write your essays for you; you are solely responsible for ensuring your application materials are your own work and comply with the rules and honor codes of the programs and institutions to which you apply.
The Service may reference or link to third-party websites and materials (for example, official university admissions pages, the Common Application, and public data sources). We do not control and are not responsible for third-party content, and a link does not imply endorsement. Essay examples are summarized for educational analysis only and link to their official published sources; we do not host or republish full third-party essays.
Paid plans are billed through our third-party payment processor. Opportunity360 Plus is a recurring subscription that automatically renews until cancelled. You may cancel at any time from Billing; cancellation takes effect at the end of the current billing period, and you retain access until then. Subscription fees are non-refundable, and we do not provide partial or prorated refunds. Counseling service packages are refundable within 24 hours of purchase, provided counselor work has not yet begun; after 24 hours, or once work has begun, package fees are non-refundable. Prices may change prospectively.
You agree not to misuse the Service, including by: violating any law or third-party right; attempting to gain unauthorized access; scraping, reverse-engineering, or overloading the Service; uploading unlawful, infringing, or harmful content; or using the Service to misrepresent your work to any institution. We may suspend or terminate access for any violation.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information (including rankings, deadlines, eligibility, and recommendations) is accurate, complete, or current. You use the Service entirely at your own risk. While we make reasonable efforts to back up your data, we do not guarantee against loss, deletion, or corruption of any content, and you are responsible for keeping your own copies of your essays and other important materials (for example, using the export/download feature).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATHURS LLC AND ITS OWNERS, MEMBERS, AFFILIATES, EMPLOYEES, CONTRACTORS, COUNSELORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ADMISSION, SCHOLARSHIP, OR OPPORTUNITY, arising out of or relating to your use of (or inability to use) the Service or any services, tools, content, data, rankings, recommendations, or counseling we provide, or any reliance on any of them, regardless of the theory of liability and even if advised of the possibility of such damages. Our total aggregate liability for all claims will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Mathurs LLC and its owners, members, affiliates, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your applications and submissions to any institution, or your violation of these Terms or any law or third-party right.
We may modify the Service or these Terms at any time; material changes take effect when posted with an updated date, and your continued use constitutes acceptance. We may suspend or terminate the Service or your access at any time. These Terms are governed by the laws of the United States and the state in which Mathurs LLC is organized, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there. If any provision is unenforceable, the remainder stays in effect.
If you purchase a counseling package, the following additional terms apply. Counseling is a professional, time-based service: fees compensate the counselor for the time spent reviewing your information and preparing and delivering your plan, and are not contingent on any result. Counseling provides no guarantee of admission, scholarship, financial aid, or any other outcome. All guidance is based on the information you provide and reflects the professional judgment and recommendations made or agreed by your assigned counselor; you and your parent or guardian are responsible for the accuracy and completeness of the information you supply and for the decisions you ultimately make. College admissions is inherently variable and subjective — different counselors may reasonably hold different opinions, and following any recommendation does not ensure a particular result. To the fullest extent permitted by law, you and your parent or guardian agree that neither CollegePlanner360, Mathurs LLC, nor any counselor will be liable for, and you will not bring any claim against them arising from, the counseling provided or any admissions or related outcome, subject to the limitation-of-liability and refund terms above.
